General terms and conditions

Status: June 2022

1. General
These Terms and Conditions (T&Cs) apply to all orders (standard and special items) placed by customers through the sunbrellaz online shop. They are a mandatory part of every sales contract between sunbrellaz and its customers. Any side agreements, assurances, or changes to these T&Cs require written confirmation.

2. Contract Formation
2.1 The purchase contract is formed when sunbrellaz sends an order confirmation to the customer via email after receiving the order.
2.2 The customer places the order online. After placing the order, the customer cannot make any changes to it.

3. Prices
3.1 The prices listed on the website at the time of order apply.
3.2 Prices are in Swiss Francs (CHF).
3.3 Price changes are reserved.

4. Shipping & Delivery Times
4.1 Delivery of ordered items is at the customer’s expense. Shipping costs include postage and packaging.
4.2 Customs fees, VAT, and similar costs for international shipments are the responsibility of the recipient.
4.3 Domestic shipments are sent via Swiss Post. Depending on the chosen shipping method, delivery generally takes between 1-3 working days. sunbrellaz is not liable for external factors, customs delays, or transportation delays.
4.4 sunbrellaz is not liable for external influences, delays at customs, or delays during transport.
4.5 Returns due to customer error will be charged to the customer.

5. Delivery Terms
5.1 sunbrellaz is not liable for undeliverable or delayed deliveries due to incorrect delivery address information provided by the customer and/or recipient absence. Any return costs will be charged to the customer.
5.2 sunbrellaz is not liable for delivery delays caused by factors beyond its control, such as delays by the delivery service, force majeure, traffic congestion, poor weather conditions, customs delays, or delays caused by third parties. Such delays do not entitle the customer to withdraw from the purchase contract or claim damages.
5.3 sunbrellaz reserves the right not to proceed with a delivery. In such cases, the customer will be contacted.

6. Payment Terms
6.1 Orders in the online shop must be paid for using the selected payment method (e.g., advance payment or credit card).
6.2 Offsetting with counterclaims by the customer is excluded.

7. Delivery Check / Complaints
7.1 The recipient is required to check the goods for completeness and condition immediately upon receipt. Any complaints regarding quality or completeness must be reported to sunbrellaz (sunbrellaz.info@gmail.com) in writing within 48 hours of delivery; otherwise, the delivery is considered accepted.
7.2 sunbrellaz is not liable for transport damage.

8. Returns, Exchanges & Right of Withdrawal
8.1 The customer has the right to return the delivered goods within 14 calendar days (from the date of delivery or confirmation of receipt). The return period is met if the goods are handed over to the post office or another shipping company on the last day.
8.2 The goods must be returned in their original packaging, complete with all accessories, and accompanied by the completed delivery/return slip and any warranty certificate. Sealed and shrink-wrapped products may only be returned if unopened, with the seal intact.
8.3 The customer bears the cost of returns. Shipping costs and gift packaging costs are non-refundable. Promotion and discount vouchers are also non-refundable. If the goods are returned in unsatisfactory condition, the customer will be charged for any depreciation in value.
8.4 Upon proper return of the goods, we will refund the total paid amount to the customer after inspection. Refunds are issued to the payment method or account used for the purchase. For returns of purchases made on account, the refund will be credited to the corresponding account.

9. Data Protection
The data necessary for processing orders is stored and shared with the delivery company as part of the order fulfillment process. Otherwise, stored data is not shared with third parties. sunbrellaz may use the data for customer care purposes.

10. Applicable Law and Jurisdiction
Swiss law exclusively applies to these contracts, excluding the Vienna Sales Convention (CISG). The exclusive place of jurisdiction is Baar, Switzerland.

11. Legal Notice
The content (texts, images, logos, graphics, animations, videos, etc.) of the sunbrellaz website and online shop is copyright-protected. Without written permission, the content may not be distributed, published, altered, reused, or sent, nor used for public or commercial purposes. sunbrellaz assumes no responsibility for the accuracy or completeness of this website and disclaims any liability for incomplete or incorrect content.
